Known for his ability to deliver a win in high-stakes, high-profile matters, he is often called upon just months or weeks before a trial. Notably, Bart and his team were retained by Gilead Sciences, Inc. to be lead trial counsel just three months before the start of the high-profile $3.6 billion HIV antitrust case. A California jury delivered a full defense verdict following a six-week trial. The verdict is only the third ever in reverse payment cases of this type, and the first ever to find for the defense on grounds of the absence of a payment and the absence of market power for the brand in the relevant market.
Bart also served as lead counsel to Miramax in a groundbreaking lawsuit against director Quentin Tarantino involving allegations of intellectual property infringement and breach of contract related to the offering of non-fungible tokens (NFTs) for the film Pulp Fiction. His leadership led to a pioneering copyright settlement, marking the first of its kind involving NFTs.
