Proskauer’s appellate team regularly handles complex and high-stakes matters involving a wide array of issues and industries before courts of appeals across the country, including the U.S. Supreme Court. Recognized by the National Law Journal as an “Appellate Hot List Finalist” and honored with multiple “Litigators of the Week” distinctions, our appellate lawyers are celebrated for their intellectual rigor, creativity and lasting impact. In the past several years, we have argued major appeals for a commonwealth in existential crisis, leading sports leagues and teams, multinational corporations and criminal defendants. Setting Precedent. Our multi-year streak of precedent-setting trial court and appellate wins for the Financial Oversight Management Board of Puerto Rico continued this past year. The restructuring of Puerto Rico is one of the most active litigations in the U.S. today and involves every aspect of civil society from the provision of electricity and sewerage to pensions for public employees. Receiving dozens of filings a day for over seven years from an army of AmLaw100 opposing counsel, Proskauer has scored an extraordinary number of victories defeating injunctions, dismissing complaints, and winning appeals, including over 60 appeals to the United States Court of Appeals for the First Circuit and the Supreme Court of the United States. Litigating new law involving complex social, business and constitutional issues, we have established precedent and created the blueprint for solving future municipal and territorial financial crises. Even more critically, we are assisting our client in establishing a better and more hopeful future for the three and half million residents of Puerto Rico.
Bet the Company Cases. Over the past several years, clients have called on us to help them navigate their most challenging disputes—and we delivered. We secured a string of major trial victories over the last 18 to 24 months, including three high-profile antitrust trial wins for Gilead Sciences, Sanderson Farms, and Major League Soccer. In addition, we serve as lead counsel for Sandoz in the largest generic pharmaceuticals antitrust litigation in the country and continue to act as trusted trial counsel to Bayer/Monsanto and Northrop Grumman in product liability & mass tort matters in federal and state courts across the country. We also serve as lead counsel for Wells Fargo in connection with a purported national class action alleging discrimination against minority home loan borrowers.
A Sports Powerhouse. Proskauer’s unparalleled experience in the sports industry remains a defining hallmark of our practice. Every major professional sports league—including Major League Soccer, Major League Baseball, the ATP Tour, the Women’s Tennis Association, the National Football League, the National Basketball Association, and the National Hockey League—turn to us for their most significant matters. Notably, we represented the “Power 5 Conferences” (Pac 12, Big Ten, Big 12, ACC, and SEC) in the 10-day bench trial of a high-profile class action brought by current and former NCAA Division I football and basketball players challenging the limits on compensation and benefits for student-athletes. Plaintiffs sought an order removing existing limitations, an order that would effectively have ended amateurism in college sports.
