Within the last year, Bart has served as the go-to trial lawyer in headline-making litigation matters. Notably, Bart and his team were retained by Gilead Sciences, Inc. to be lead trial counsel just three months before the start of the $3.6 billion HIV antitrust case and delivered a total defense verdict following a six-week trial. The verdict was the third ever in reverse-payment cases of this type, and the first ever to find for the defense on grounds of the absence of a payment and the absence of market power for the brand in the relevant market.
Bart also served as lead trial counsel for Netflix, acclaimed director and writer Ava DuVernay and award-winning writer Attica Locke in a defamation case brought in federal court in New York by former longtime head of the Manhattan District Attorney’s Office sex crimes unit. Bart’s counsel led to an extremely successful resolution for the clients when the plaintiff decided to settle the case on the eve of trial with no payment to her or her lawyers, and no confidentiality provision related to the settlement.
